Terms Of Service

In this agreement, "we" represents Haruka Cloud, and "you" represents the customer who purchases our services. "Member" refers to individuals or organizations who purchase our services. "Registrant" refers to individuals or groups who apply for domain name registration. "Registry" refers to the domain name management authority. "Server" represents the computer equipment that provides services to you. "Website" represents the content you upload to our server that can be accessed on the Internet. "Service Terms" refers to this agreement. Haruka Cloud reserves the right to modify these terms at any time, and the new service terms will take effect immediately upon publication on the website.


1. Payment

  1. Payment methods are limited to the payment provided by us.
  2. You must make the payment before the receipt expires. Otherwise, we have the right to close the receipt.
  3. If an unredeemed payment uses a promotional code with a quantity limit, the application will be based on the order of generating the receipt. If the limit is reached, a receipt without the promotional code will be generated for you.
  4. The prices in the shopping cart are for preview purposes only. The bill generated at checkout will be the final amount.
  5. If you use a referral link from another account owned by you at the time of purchase, we have the right to suspend both the referral account and the purchasing account.


2. Technical Support

  1. Tickets will be responded to within 24 hours. Compensation will be provided if no response is received within 24 hours.
  2. Technical support will attempt to resolve your issues as much as possible. However, we cannot solve problems related to the inability of your website to generate profit (similar issues beyond our control, please understand).
  3. If the wrong department is selected for the ticket, an employee will transfer it to the correct department for you, but the response time may be longer.
  4. The ticket department provides language support in English, Simplified Chinese and Traditional Chinese.


3. Refunds

  1. Once a product is sold, we only accept reasonable refund requests within 24 hours. No replacements will be provided.
  2. If a product is taken down or experiences server failure exceeding 24 hours before the service expires, you can apply for a refund based on the remaining service time.
  3. Any refunds processed will be credited to the account balance. Initiating disputes or similar actions without prior communication through the payment gateway will result in no refunds, and we reserve the right to terminate all products under that account and restrict access to the account itself.
  4. We do not provide refund guarantees in the following circumstances:
    • Personal attacks on customer service personnel during the communication process
    • Suspension or termination due to violations of the Terms of Service (ToS)
    • Malicious trial of products
    • Over 12 hours since the completion of payment
    • IP address banned due to attacks, outgoing packets, etc.
    • Multiple repeat purchases and refunds (three times or more)


4. Service Suspension

  1. If the service expires and payment has not been made, we provide a 1-day grace period for the host to continue service. After 3 days of service expiration, it will be suspended.
  2. If payment is not made within 3 days after the service expires, we will proceed with the deletion of the service, and the data on the server will be irretrievable.
  3. Normal billing will continue during the service suspension period.
  4. Violations of Haruka Cloud's service terms or restrictions give us the right to suspend or even delete your services.
  5. We are not responsible for data loss caused by service expiration.


5. Virtual Hosting Content

  1. You are not allowed to use the virtual hosting for sending spam or advertising emails.
  2. You are not allowed to use the virtual hosting for network proxy purposes (including programs like zmirror and similar proxy websites).
  3. You are not allowed to host illegal websites. Please refer to the product usage restrictions.
  4. Any illegal activities conducted on Haruka Cloud's services may result in host suspension or deletion. Haruka Cloud reserves the right to take appropriate action within the limits permitted by law. Haruka Cloud also reserves the right to report to law enforcement agencies.
  5. Your host is protected by our security components, but we cannot guarantee defense against zero-day vulnerabilities or unauthorized modifications to the server.
  6. Haruka Cloud reserves the right to delete the following files without your permission: any pirated, cracked, adult, pornographic content, and copyrighted video or audio files.
  7. You are not allowed to store the following files on the virtual host:
    • Content that contains viruses, trojans, or other programs that cause damage to the server or visitors' computers.
    • Content that plans, promotes, or encourages criminal activities or undermines trademark protection, copyright protection, or patent protection.
    • Content that jeopardizes global security.
  1. If the virtual hosting series does not have a dedicated identification, please use server resources reasonably and comply with the "Usage Restrictions" specified. You should not interfere with other customers' normal usage.


6. Virtual Private Server (VPS) Content

  1. You are not allowed to use the VPS for sending spam or advertising emails.
  2. Any illegal activities conducted on Haruka Cloud's services may result in host suspension or deletion. Haruka Cloud reserves the right to take appropriate action within the limits permitted by law. Haruka Cloud also reserves the right to report to law enforcement agencies.
  3. Any form of hacking behavior, such as trojan viruses, IP scanning, external attacks, port scanning, or attempted intrusion on any computer or network.
  4. Placing chat rooms, forums, audio, video, high-traffic downloads, and other resource-intensive programs or activities (including but not limited to scraping).
  5. Mining activities are prohibited.
  6. Providing free public proxies is prohibited. Once discovered, the account will be suspended until expiration.


7. Virtual Private Server (VPS) IPv4 Address Replacement

  1. If IPv4 address is blocked after paid, you can submit a ticket within 24 hours to request a manual free replacement.
  2. The IPv4 address of a VPS can be changed for a fee of 5 USD per change.
  3. If you require a specific IP address range, please contact our sales team to obtain a solution.
  4. During special periods with a large number of blocked IP addresses, we reserve the right to temporarily increase the fee.
  5. If an IPv4 address is blocked by certain countries during the device rental period due to the user's own actions causing problems, disputes may arise. Haruka Cloud has the right to charge for the loss of IPv4 address property (depending on the situation).


8. Account

  1. You are the account holder, and each VPS you use represents a separate service. We will only provide services to you if we have your real name and valid and sufficient contact information. If your contact information contains invalid information (such as incorrect name, address, phone number, etc.), we may suspend or terminate the services we provide to you at any time. We may seek verification of your contact information with third parties.
  2. If you cannot provide valid and sufficient contact information, or if we cannot verify your contact information, we reserve the right to delete the relevant services and accounts.
  3. You are responsible for the security and confidentiality of your account password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.


9. Intellectual Property Rights

  1. All content provided on the website is protected by intellectual property rights and is owned by Haruka Cloud or its licensors.
  2. You may not reproduce, distribute, modify, or create derivative works of any content on the website without our prior written consent.
  3. You may not use any trademarks, logos, or service marks displayed on the website without our prior written permission.


10. Termination

  1. We may terminate this agreement and suspend or terminate your access to our services at any time for any reason, including, but not limited to, breach of the service terms.
  2. Upon termination, your rights to access and use our services will immediately cease, and you must cease all use of our services and return or destroy any materials obtained from our services.


11. Governing Law

  1. This agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Haruka Cloud is registered.
  2. Any disputes arising out of or in connection with this agreement shall be submitted to the exclusive jurisdiction of the courts in the jurisdiction where Haruka Cloud is registered.


12. Disclaimer

  1. Customers are responsible for ensuring their data's security. While we aim for utmost reliability, we cannot guarantee against unforeseen issues.
  2. We are not responsible for data loss stemming from hardware malfunctions or customer-initiated problems. However, if data loss arises due to our errors, we will offer assistance but cannot ensure complete recovery.
  3. We also disclaim responsibility for service inaccessibility resulting from DDoS attacks or instances of hacking.


13. Severability

  1. If any provision of this agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.


By using our services, you agree to abide by these terms. If you do not agree to these terms, please do not use our services.
